Public Access to Documents

Citizens of the European Union and natural or legal persons residing or having their registered office in a Member State have the right of access to ENISA documents.

According to the transparency rules as set out in the Lisbon Treaty, EU Institutions and Bodies work as openly and as closely as possible to citizens.

Citizens of the European Union and natural or legal persons residing or having their registered office in a Member State have the right of access to ENISA documents under Article 255(1) of the EC Treaty and Article 2(1) of Regulation (EC) No 1049/2001 in accordance with detailed rules laid out in the implementing rules adopted by the ENISA Management Board on 27 December 2019. This right to access concerns documents held by the ENISA, meaning, documents drawn up or received by it and in its possession.

Pursuant to article 2(2) of Regulation (EC) No 1049/2001, citizens of third countries not residing in a Member State and legal persons not having their registered office in one of the Member States shall enjoy the right of access to ENISA documents on the same terms as the beneficiaries referred to in Article 255(1) of the EC Treaty and Article 2(1) of Regulation (EC) No 1049/2001.
